The petition was reportedly launched on 8. February sent by FDA to Regulations.gov for public comment.

"It is generally known, that the use of vaping products in the United States has shifted to disposable products. A new enforcement policy, which specifically targets these illegally marketed single-use products, is required, to better protect public health.”, the petition says.

The petition suggests, that the FDA prioritizes enforcement against the following manufacturers or products:

* Disposable e-cigarettes of all flavors (excluding products containing tobacco- or menthol flavor);

*All non-tobacco nicotine Disposable e-cigarettes without prior marketing authorization;

*Disposable e-cigarettes with tobacco nicotine, the on 8. August 2016 were not on the market or whose manufacturers failed to do so, until 9. September 2020 to submit an application, or whose PMTA was submitted to the FDA by this deadline, but negative receipt act not verified in court;

* The manufacturer failed (or missed it), to take appropriate action, to prevent, that minors are exposed to disposable e-cigarettes;

*Any disposable e-cigarette, which is intended for minors, or their marketing may encourage use by minors.

Reynolds Tobacco wrote about his ideal enforcement priorities: “Such a policy would address existing gaps in FDA's current tobacco enforcement efforts, especially with regard to young people.”
